Isle of Palms EBike Co LLC AGREEMENT ALL PARTIES AGREE THAT ANY DISAGREEMENTS, DISPUTES OR CLAIMS UNDER THIS LETTER OF AGREEMENT SHALL BE SETTLED BY BINDING ARBITRATION ACCORDING TO THE RULES OF THE SOUTH CAROLINA UNIFORM ARBITRATION ACT. BOTH PARTIES KNOWINGLY AND VOLUNTARILY WAIVE THEIR RIGHT TO BRING CLAIMS UNDER THIS AGREEMENT TO ANY COURT OF PROPER JURISDICTION AND AGREE TO BE BOUND BY THE ARBITRATORS’ DECISION.
1. PARTIES. The following contract between Isle of Palms EBike Co LLC (herein “Rental Company”) and Renter (as defined below), is for the rental of an electric bike (herein “Property”) owned by Rental Company. Renter hereby agrees to all terms and conditions contained within this contract.
2. RESERVATION OF TITLE. Renter hereby acknowledges that Rental Company will retain all ownership and title to the Property throughout this agreement.
3. PROPERTY. The Property shall be picked up from an agreed upon location or rented directly from the shop.
4. RIGHT OF ENTRY. Rental Company shall have the right to enter onto any part of Renter’s property to regain possession of the Property.
5. RENTAL FEE. Renter agrees to pay the Rental Rate as specified on the following page plus an 11.5% tax & processing fees.
6. LATE FEE. Renter shall be charged a late fee if he/she does not return Property at the time designated on page 2. The late fee shall be as follows: Renter shall be charged an additional fee of $25 per hour for every hour that the Property is not returned after the designated pick up time. Additional fees will be charged 10 minutes after scheduled return time, and will continue every hour thereafter;
7. RENTER’S REPRESENTATIONS AND WARRANTIES. Renter/Passenger hereby acknowledges that he/she is 16 years old or older. If under 18, a guardian must be present to sign release form. Isle of Palms EBike Co LLC will not be held accountable for any disputes, damages, or injuries for persons under the age of 21. Renter/Passenger hereby agrees that a helmet must be worn by any driver/passenger under the age of 21 during operation of Property. Helmets will be provided to every renter regardless of age. It is renter’s responsibility to wear proper riding attire. Renter hereby agrees to be the sole driver of the property, and to not let any other person use the property during the period of this rental agreement.
Port Isle of Palms EBike Co LLC is not responsible for any lost or stolen personal items. Renter is responsible for all tickets issued by state or local police. If rental property is towed during rental, renter is responsible for all fees and costs to return bikes to Isle of Palms EBike Co LLC.
8. INSPECTION & RESPONSIBILITY. Renter has had the opportunity to inspect and review the property that is the subject of this Rental Agreement, and accepts the property in the condition as it is provided. Renter shall be responsible for any and all repairs. See separate Inspection Sheet to note preexisting damage. If bike is stolen, renter is responsible.
9. LOCATION OF USE. Renter shall use the equipment only within the following limits: City Limits of Use Mt. Pleasant Mt. Pleasant, east of Ravenel Bridge. South of HWY 41 Isle of Palms/Sullivan’s Island Isle of Palms and Sullivan’s Island.
10. NO ASSIGNMENT. Neither this Rental Agreement nor any right or interest thereunder shall be assigned by Renter in any respect whatsoever.
11. CHOICE OF LAW. This Rental Agreement shall be deemed to have been executed and entered into in the State of South Carolina and shall be construed, enforced and performed in accordance with the laws thereof.

GENERAL RELEASE OF LIABILITY FOR RENTAL OF SCOOTER This General Release of Liability is freely and voluntarily entered into between Isle of Palms EBike Co LLC including its employees, members, representatives and agents, (collectively hereinafter “RENTAL COMPANY”) and (hereinafter “RENTER”). It is fully understood by RENTER that the use and operation of a moped provided by RENTAL COMPANY is inherently dangerous and could result in serious bodily injury or even death. Helmets will be given to all customers free of charge.
Renters under the age of 21 are required by law to wear helmet at all times while operating moped. Customers 21 and over are expected to wear helmet but it is not mandated by law. RENTER knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of RENTAL COMPANY or others, and assumes full responsibility for their own injuries. RENTER, for themselves and on behalf of their heirs, assigns, personal representatives and next of kin, hereby releases and holds harmless RENTAL COMPANY with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of RENTAL COMPANY or otherwise, to the fullest extent permitted by law. If riding with a passenger, renter is responsible for any and all passengers riding with them in accordance with rental and driver responsibilities.
